CBI Files FIR Against Rhea Chakraborty, Actress Calls It Illegal, Against Federalism

A day after Sushant Singh Rajput’s case was transferred to CBI, the agency has filed an FIR against six people, including Rhea Chakraborty and her family members. Rhea has been named as an accused in the FIR.

The FIR mentions the name of Rhea’s father Indrajit Chakraborty, mother Sandhya Chakraborty, brother Showik Chakraborty, Sushant’s house manager Samuel Miranda, Shruti Modi and unknown others.

All these people have been charged under several IPC sections including abetment of suicide, criminal conspiracy, wrongful restraint/confinement, theft, criminal breach of trust, cheating and other offences.

After the case was transferred to CBI by the Central government, Rhea, as per a report by NDTV, made a statement that CBI must stay away from the case until Supreme Court d has given its verdict on the issue.

She added that Sushant died in Mumbai thus Bihar police shouldn’t be interfering in the case until the Supreme Court allows it to.

For the unaware, a CBI inquiry can only be launched by the Central government (with the consent of the state) or the Supreme and High court without any such consent.

An investigation by the CBI at this point will be “totally illegal and beyond any known legal principles, affecting the Federal Structure of the Nation,” she said in a statement.

Interestingly, she is the same Rhea who has been demanding a CBI inquiry into the case since forever. She had earlier tweeted to Home Minister Amit Shah asking him to launch a CBI inquiry.

Maharashtra is yet to agree to a CBI investigation and going by the rules, without the state government’s acceptance, the agency cannot question people in the state.

Ms Chakraborty argued that Bihar police shouldn’t be handling the case because she believes it would be unfair. “The Bihar Government transferred a case with which it had NO Jurisdiction to investigate, to CBI instead of The Mumbai Police,” her statement read.
